When you purchase Executive-to-Fractional™, Executive-to-Fractional™ | Grow in Grace, Breaking Into the Market + Revenue Recipe™, the Complete System, private advisory or another product or service, we may collect information needed to complete the transaction and deliver what you purchased.  If your purchase includes a private advisory session, you may be asked to submit designated workbook sections, professional information, questions or other preparation materials. These are used to prepare for and provide your advisory session and, where relevant, support the ongoing professional relationship.

6. Payments

Payments are processed through third-party payment providers such as Stripe, Credit Cards, Klarna, ClearPay, and others. We generally do not receive or store complete payment-card details. Payment providers process payment information under their own terms and privacy practices. We may retain transaction records for accounting, tax, customer-service and legal purposes.

7. Service Providers and International Transfers

We may use third-party providers for website hosting, ecommerce, payments, scheduling, email, cloud storage, analytics, communications and digital-product delivery. These may include Squarespace, Google, Calendly and others.  Some providers may process information outside the United Kingdom. Where required by law, we will use appropriate safeguards for international transfers.

Where permitted, we may send information about products, services, resources or events that may be relevant to you. You may unsubscribe from marketing communications at any time using the unsubscribe option in the communication or by contacting us.  Operational communications relating to a purchase, booking or existing client relationship are not marketing communications.

TERMS & CONDITIONS / DIGITAL PRODUCT TERMS

These Terms govern use of Beth Kenney and purchases of digital products, systems, workbooks, advisory sessions and related services offered by [LEGAL/TRADING NAME], trading as Beth Kenney / The Beth Kenney System. By placing an order, you agree to these Terms. Nothing in these Terms limits rights that cannot lawfully be excluded.

1. Products and Services

Products and services may include Executive-to-Fractional™, Executive-to-Fractional™ | Grow in Grace, Fractional Sweet Spot™, First 50™, Breaking Into the Market, Revenue Recipe™, downloadable workbooks and resources, Complete System bundles, and private advisory sessions.  Product descriptions explain the principal content included. We may make reasonable non-material updates to formatting, presentation or supporting materials from time to time.

2. Eligibility and Personal Use

Purchases are intended for adult customers. Digital products are licensed to the individual purchaser for that purchaser’s personal or internal professional use only. Purchase does not transfer ownership of the intellectual property.

3. Prices and Payment

Prices are displayed at checkout in the stated currency. Launch, founding, promotional and standard prices may change at our discretion before purchase. The price accepted at checkout is the price applicable to that transaction.

You are responsible for any currency-conversion charges, bank charges, taxes or similar amounts imposed by your provider or applicable law, unless expressly stated otherwise.  All purchases products and services are non-refundable, non-transferable.

4. Digital Delivery

Digital products are supplied electronically, normally by download link, customer account, email or another digital delivery method stated at checkout.

You are responsible for providing a correct email address and for downloading and securely retaining your purchased files. If you experience a genuine technical problem accessing a purchased file, contact excellence@bethkenney.com

5. Immediate Digital Supply and Cancellation Right

Where you are purchasing digital content for immediate download or access and applicable consumer law gives you a cancellation period, we will ask you at checkout to expressly consent to supply beginning immediately and to acknowledge that, once supply begins, you lose the statutory right to cancel that digital-content purchase.
If the legally required consent and acknowledgement are not obtained, your statutory cancellation rights may continue notwithstanding any other wording in these Terms.

6. Private Advisory Sessions

Where a product includes a Private Advisory Session with Beth, you must complete and submit the designated preparation materials at least 48 hours before the scheduled session unless otherwise agreed.

The purpose of the session is strategic review, discussion, pressure-testing and guidance. It does not guarantee a particular career, business, revenue, investment or financial outcome.

Rescheduling and missed-session arrangements, if any, will be stated at booking or agreed directly with you. A private advisory session is personal to the purchaser and may not be transferred to another person without our written agreement. We reserve the right to cancel such sessions if client neglects to inform and/or repeated cancellations less than the requested 24-hour cancellation period.

7. No Guaranteed Results

Our products and services provide frameworks, education, strategic thinking, prompts and advisory input. Your results depend on many factors outside our control, including your decisions, implementation, market conditions, experience, relationships, timing and commercial execution. No representation or guarantee is made that you will secure employment, clients, contracts, revenue, investment, promotion or any specific financial result.

8. Professional Advice

Content is educational and strategic in nature and is not legal, tax, regulated financial, investment, accounting, medical or mental-health advice. You should obtain appropriately qualified professional advice where required for your circumstances.

9. Intellectual Property

Unless expressly stated otherwise, all systems, methodologies, workbooks, copy, frameworks, exercises, templates, designs and materials supplied through The Beth Kenney System are owned by or licensed to Beth Kenney are protected by applicable intellectual-property laws. This includes, where applicable, Executive-to-Fractional™, Fractional Sweet Spot™, First 50™, Breaking Into the Market, Revenue Recipe™, Grow in Grace and associated materials.

You may use purchased materials for your own personal or internal professional development. You may not reproduce, republish, sell, sublicense, distribute, upload, share, teach, adapt for resale, create a competing product from, or commercially exploit the materials without prior written permission.

10. Non-Transferability and Account Sharing

Purchases, licences, download links and advisory entitlements are personal to the purchaser and are non-transferable except where we expressly agree otherwise in writing. You may not share purchased digital files or access credentials with colleagues, clients, friends, groups or organisations.

11. Acceptable Use

You agree not to misuse the website, interfere with its operation, attempt unauthorised access, copy protected materials at scale, or use our intellectual property in a way that infringes our rights or the rights of others.

12. Availability and Technical Issues

We aim to keep the website and digital delivery systems available, but uninterrupted access cannot be guaranteed. We may reasonably suspend access for maintenance, security or circumstances beyond our control. If a technical issue prevents delivery of something you have purchased, contact us so that we can provide a reasonable remedy.

13. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded under applicable consumer law. To the extent permitted by law, we are not responsible for indirect or consequential losses arising from business decisions, lost opportunities, lost profits or reliance on educational or advisory materials, except where such limitation is prohibited by law.

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you in the country where you live. Any dispute will be handled by the courts with jurisdiction under applicable law.

REFUND, CANCELLATION & TRANSFER POLICY

OUR COMMERCIAL POLICY: ALL SALES ARE FINAL, NON-REFUNDABLE AND NON-TRANSFERABLE, EXCEPT WHERE APPLICABLE LAW REQUIRES OTHERWISE.

1. Digital Products

Because our digital products provide immediate access to proprietary intellectual property and downloadable materials, purchases are non-refundable and non-transferable once digital supply has begun, except where you have a statutory right to a remedy.  For consumer purchases where a statutory cancellation period would otherwise apply, checkout should require your express consent to immediate digital supply and your acknowledgement that you lose the cancellation right once supply begins.

2. Your Statutory Rights

This policy does not remove or restrict rights that cannot lawfully be excluded. If digital content is faulty, not as described, not supplied as agreed, or you otherwise have a statutory right to a remedy, we will comply with applicable law.  Accordingly, “all sales final” does not mean that we refuse remedies where the law requires one.

3. Change of Mind

Subject to your statutory rights, we do not provide refunds because you changed your mind, did not complete the system, decided not to pursue fractional or advisory work, no longer have time to use the materials, found the content more or less advanced than expected, or did not achieve a desired commercial result.

4. Bundles and Complete Systems

Bundles and Complete System purchases are sold as a single product package. Subject to applicable statutory rights, we do not provide partial refunds for unused, uncompleted or unwanted components of a bundle.

5. Private Advisory

Private advisory sessions included within a product or package are non-refundable and non-transferable, subject to applicable law. Where preparation materials are required, designated sections must be submitted at least 48 hours before the session unless otherwise agreed. If you need to reschedule, contact excellence@bethkenney.com  a requested minimum 24-hours prior to session. Any permitted rescheduling is at our discretion and subject to the booking terms communicated to you.  Failure to attend a scheduled session or failure to submit preparation materials does not automatically create a right to reschedule.

6. Duplicate Purchases and Technical Problems

If you believe you were charged twice in error or cannot access the digital files because of a genuine technical delivery problem, contact  excellence@bethkenney.com We will review the issue and, where appropriate, correct the duplicate transaction or restore access. This does not create a general change-of-mind refund right.

7. Non-Transferability

Purchases may not be transferred, assigned, gifted after purchase, resold or exchanged for another product or service unless we expressly agree otherwise in writing.
